What the Federal PACT Act Means and Doesn’t Mean for Iowa’s Animals

On Nov. 25, 2019, President Trump signed into law a bill making some cases of animal cruelty a federal felony.

The Preventing Animal Cruelty and Torture (PACT) Act is an amendment to a federal law specifically related to fetish “crush videos.” The original law made the production, possession, and sale of such videos a federal felony, but it did not criminalize the underlying act of cruelty itself. The PACT Act fills that gap by making the act of cruelty a federal felony.

However, the PACT Act only applies in very narrow circumstances related to crush videos, and then only in jurisdictions where no state or local laws apply. You can read more about the PACT Act at Govtrack.us

While this law is significant, the PACT Act does not apply to the vast majority of animal cruelty cases in Iowa and across the nation.

Iowa currently ranks 48th in the country for the effectiveness of its animal protection laws, but a bill (HF737) that was signed into law in 2020 makes several key improvements to Iowa’s companion animal cruelty laws, including increased penalties, improved definitions related to standards of care, and mental health evaluations and restrictions on future possession of animals in certain cases.

On June 29, 2020 Governor Reynolds signed HF737 into law, marking a huge victory for Iowa’s companion animals. The law went into effect July 1, 2020. To read more about what the law will do to protect animals, click here.

She Arrived with a Broken Leg and Pelvis

How does a young cat like this end up with a severely broken leg and pelvis?

We may never know how this poor kitty got these horrific injuries. But we do know she needs surgery right away to save her life.

Thankfully this very sweet cat, who we named Gracie, was brought to the Animal Rescue League. A tiny cat at just 6 pounds, she was very quiet and in severe pain when she arrived, with abrasions on her stomach and an obviously broken leg. She weakly tried to stand but her injuries were too severe.

She was given pain medications immediately, and X-rays taken by our Emergency Care Team revealed even more serious injuries — she is not only suffering from a broken leg, but a broken pelvis, too.

In partnership with the Polk County Sheriff’s Office, The Animal Rescue League of Iowa is offering a $1,000 reward for information leading to an arrest and conviction of the person(s) involved with the kittens that were burnt.  Anyone with information in this case should contact Crime Stoppers of Central Iowa at 515-223-1400 or submit the tips online at www.polkcountycrimestoppers.org.

The ARL would like to extend a huge thank you to the Polk County Sheriff’s Office for utilizing this reward in their investigation. We hope it will help lead to a quick resolution in this case.

Hans and Greta underwent surgery yesterday and are recovering in the ARL’s Miracle Medical Ward under the close supervision of our veterinary team.

It’s been a truly horrific week of animal abuse in Des Moines: 2 dogs were starved to death by their owner, a cat survived a stabbing and drowning attempt by a woman who lived in the home, and now this: a box of 9 kittens set on fire with two suffering severe injuries and the others escaping with singed fur and ash.

We can’t even imagine the terror and pain they experienced. Our hearts ache just looking at them.

Thankfully, Polk County Animal Control Officers were able to rescue the scared and injured 4-6-week-old kittens over multiple days. They brought the unharmed kittens to the ARL and the injured kittens to an after-hours emergency vet clinic. The two 4-week-olds with severe injuries arrived at the ARL’s Miracle Medical Ward yesterday and are receiving pain medications, antibiotics, burn cream, and eye medication to manage their pain and treat their burns.

The two kittens, who we named Greta and Hans, are receiving critical surgery today to remove the dead tissue from their burns, make them more comfortable, and help their wounds heal. They are suffering from burns over much of their bodies, including all four paws and their ears, noses and lips. Greta is suffering from the most severe and extensive burns. She is lucky to have made it out when she did.

Greta and Hans will remain under the care of our three staff veterinarians, and their healing is expected to take months. We don’t know yet if they will need additional surgeries or procedures as they recover, but we do know that with your support, they will never again experience the horror they endured.

Senate Bill HF737: Must Pass Without Amendment

The Animal Legal Defense Fund just released its state animal protection rankings, and Iowa has surged… down to 49th, only ahead of Mississippi. This embarrassing ranking reflects the failure of our current law to properly define and punish animal cruelty. This is a gravely serious problem because it has been proven that unchecked violence towards animals leads to escalating violence against other people. Fortunately there’s an easy solution: HF737, which passed out of the Iowa House last year 96-0. Now the Senate needs to do its job, and pass HF 737 without amendment.

Just how bad are Iowa’s animal welfare laws? Recent stories speak for themselves and they are happening across the state: Trap a Chihuahua in its crate, and toss it into a dumpster to starve in Central Iowa? Simple misdemeanor, five days in jail. Severely beat a dog and cut its throat in Eastern Iowa? Aggravated misdemeanor, ten days in jail. Hang the family dog to death in the garage for barking too much in Central Iowa? Two years’ probation, no jail time.

How could the law let this happen? You’ll find the answer buried in the fine print. Iowa’s companion animal cruelty law, Chapter 717B, includes three levels of cruelty charges depending on the nature and extent of the conduct: neglect, abuse, and torture. Unfortunately, all three charges suffer from bad definitions and weak punishments.

The legal definition of “abuse” requires that the victim animal belong to someone else. We call it the “owner exception” and it means, under Iowa law, an owner can’t technically “abuse” their own animal. Next, the definition of “torture” requires the prosecutor to prove that the defendant had a “depraved or sadistic intent.” If you’re confused by that requirement, you’re not alone: even the Iowa Court of Appeals couldn’t decide what it means, and reversed a torture conviction in Eastern Iowa where the defendant had beaten a Boston terrier puppy to death with a baseball bat.

These defects in our cruelty laws force prosecutors to charge most cases as mere neglect, a misdemeanor offense. Even then, the definition of “neglect” is poor. To beat a neglect charge, a defendant only need prove they provided a “sufficient quantity” of food and water, and “adequate shelter.” The law does not require proper quality food, or that the water be potable. Nor does the law require even basic veterinary care. That issue prevented bringing charges in a recent case from Northern Iowa where the ARL rescued 13 dogs suffering from fleas, skin/ear infections, and severely overgrown nails that made it too painful to walk. These dogs won’t get justice thanks to our bad laws.

Even where prosecutors clear these hurdles and land a conviction, the punishment is typically a slap on the wrist. Consider one recent case: a grown man, angry at the family dog for chewing his sunglasses, held it down and repeatedly beat it with a belt and his closed fist. He even forced his child to record the incident as a warning to the other children. He received seven days in jail and a year of probation.

That case illustrates the grotesque and direct connection between violence against our companion animals and violence against other humans. The statistics are shocking:

  • Animal abusers are five times more likely to cause harm to other humans;
  • 85% of women and 63% of children entering domestic violence shelters also report animal abuse;
  • More than 80% of families being treated for child abuse were also involved in animal abuse;
  • 70% of all animal abusers have committed at least one other criminal offense and almost 40% have committed violent crimes against people;

Researchers call this “The Link.” Indeed, the research is so consistent that the FBI now tracks animal crime statistics nationwide. In other words, animal cruelty is a huge red flag that demands immediate intervention to prevent future violence.

Fortunately, there’s a solution ready to go: HF737, which would:

  • Remove the “owner exception” for abuse;
  • Remove the “depraved or sadistic intent” requirement for torture;
  • Improve the definition of neglect to require nutritionally sufficient food, access to potable water, sanitary living conditions free of waste, suitable shelter based on the animal’s specific needs, and veterinary care to relieve suffering;
  • Enhance the penalties for these offenses;
  • Make animal torture causing death a first-offense felony; and
  • Require defendants to undergo mental health evaluation and treatment in almost all cases to reduce the chance of future violence against humans.

This is not a radical change: our neighbors in Illinois, Missouri, Nebraska, South Dakota, Minnesota and Wisconsin all have laws similar to HF 737. This is not a partisan issue; last year this bill passed unanimously (96-0) out of the Iowa House, and the Trump Administration recently passed its own animal welfare bill (for specific animal crimes that does not address the concerns covered in HF 737). Despite all of this, the future of HF 737 remains in doubt. Some Iowa Senators complain that this bill would harm the interests of livestock producers. This is nonsense. HF 737 makes zero changes to our livestock laws – this bill is for companion animals only.

Since December 1, many have contributed to our Tree of Life program throughout the Des Moines area with many toys, treats, and other useful supplies. These items will help us give homeless and neglected pets a second chance at a safe and happy life.

June is Adopt a Shelter Cat Month

ARL KittensJune is Adopt-A-Shelter-Cat Month, and the timing to celebrate cat adoptions couldn’t be more perfect since kitten season is in full swing. Cats and kittens of all ages need your help now more than ever, and here’s how you can help:

  • Adopt. Yes, this is the obvious idea, but before you commit to furry parenthood, make sure you have the time, space, and budget to properly care for a cat. If you do decide to adopt, remember that senior cats need homes too!
  • Foster. Maybe you can’t commit to adoption at this time, but perhaps you can foster. Fostering gives a cat a break from shelter life and often reveals an entire new kitty personality!
  • Have a fundraiser. If you can’t adopt, set up a fundraiser to raise money for a local shelter. Have a bake sale, run a car wash, or even set up a lemonade stand with your children. Have fun with it!
  • Donate. Shelters go through lots of kitty litter, cat food, kitten food, treats, toys, beds, and towels all year long, but these items vanish even more quickly during kitten season. Donating even a few of these items to a local shelter will help out a bunch!

Spread the word. Almost everyone has at least one social media account nowadays. Use it (or them) to educate your friends and family about Adopt-A-Shelter Month. The more people who know, the more likely homeless cats and kittens will be adopted!
